Additional terms govern the sale and use of goods by trade (wholesale) customers and are available upon request. If you do not wish to be bound by the Terms you should not access or use the Website. This Website and its contents are the property of Imiis Limited. Imiis Limited may modify or vary the Terms in its absolute discretion from time to time. It is your responsibility to access the Terms each time you visit the Website. By using this Website you accept the latest Terms. If you are not a consumer you confirm that you have authority to bind any business person on whose behalf you use this Website.

Goods

Imiis Limited specializes in new products and services (“Goods”) and its first is the SimiWeave™ range of products (hairpiece covering the head and made of human or synthetic hair) and accessories (shampoos, conditioners and other products produced for the maintenance of the pieces).

Orders

All Orders placed on this Website will be subject to acceptance in accordance with these Terms. Imiis Limited processes and dispatches orders on working days only defined as Mondays to Fridays 09.00 to 18.00 GMT (except for public and national holidays). When you place an order to purchase goods from Imiis Limited you will be sent an e-mail confirming receipt of your order containing the details of your order. This email confirms acceptance of your order and the completion of the contract between you and Imiis Limited. The email will be sent to the e-mail address you provide Imiis Limited with on your order details. Whether or not you receive the e-mail, our acceptance of your order will create a contract between us.

Availability

All goods are subject to availability. Any goods on the same order which have not been confirmed in an email do not form part of that contract. In the event that Imiis Limited is unable to supply the goods, Imiis Limited will inform you of this as soon as possible by email. A close alternative will be offered and, if appropriate, a back-in-stock date for the items you have ordered. If Imiis Limited has to cancel your order, for whatever reason, it will be without charge to you and you will be informed of this by email.

Payment

All transactions conducted on this Website are in Pound Sterling (GBP). Imiis Limited cannot accept your order until you have paid for the goods in full (including VAT and all applicable delivery charges). The price for the goods is the price displayed on the Website at the time Imiis Limited receives your Order, except in the following situation: While Imiis Limited tries to ensure that all prices on the Website are accurate, errors may occur. If Imiis Limited discovers an error in the price of the goods you have ordered Imiis Limited will inform you as soon as possible by email and give you the option of reconfirming your order at the correct price or canceling it. In this instance if you chose to cancel the order, you will receive a full refund. If Imiis Limited is unable to contact you by email, Imiis Limited will treat the order as cancelled and a full refund will be provided. Payment can be made by credit or debit card. Title in the goods you have ordered passes from Imiis Limited to you upon dispatch of the goods, provided Imiis Limited has received payment for the goods in full. The price for the goods is inclusive of the UK 's VAT at the prevailing rate but exclusive of delivery charges which will be added and are payable by you.

Dispatch & Delivery

Whilst Imiis Limited makes every effort to dispatch goods within the timescales published, all dispatch times stated by Imiis Limited shall be treated by you as an estimate only. No liability can be accepted by Imiis Limited for any delay or failure to dispatch the goods within the estimated timescale. Risk of loss or damage of goods passes to you on the date of when the goods are dispatched by Imiis Limited. Delivery times and charges are set in line with the delivery times and charges offered by Royal Mail and Airsure and the other postal and delivery companies used by Imiis Limited. Charges consist of (i) a standard administrative handling charge for each order which includes the cost of the packaging, and, (ii) the prevailing postage charge for Special Delivery or Recorded Delivery (signed for delivery) set by Royal Mail and Airsure and the other postal and delivery companies used by Imiis Limited. Delivery charges will be confirmed at the time of order by email. Imiis Limited shall deliver the goods to the address provided by you in your order details. Delivery by Royal Mail and Aisure and Airsure and the other postal and delivery companies used by Imiis Limited is always signed-for, and it is your responsibility to provide an address that is ocuppied during office hours (Mondays to Fridays 09.00 to 18.00 local time). If for any reason the delivery of the goods cannot be accepted at the time when goods are due, Imiis Limited shall be under no obligation to track the delivery, arrange re-delivery or pay for the costs of re-delivery of the goods. Imiis Limited will pass the costs of insuring the goods if they have to be held in storage to you.

Disclaimer

Imiis Limited measures the length of the hair from the top of the head which is actually the correct way to measure hair. Other brands measure from the ear and this is why it may appear at first that the length on the hair on our products are shorter. Colours and the appearance of textures vary on screen from computer to computer so you may not be viewing a true representation of the actual colours or textures. The colours shown here are for reference only and are based on human hair wigs. Colours vary according to hair texture so will be different on the human hair to the synthetic hair pieces. Owing to the hand-made production of the pieces and the chemical processing - which are subject to environment conditions and fluctuations - that takes place to colour and texture the pieces, our pieces can vary from batch to batch in terms of length, colour, volume and texture. Ocassionally we are able include a few extra inches of hair, for free, meaning that our products can also fluctuate in length from batch to batch.

Returns

Owing to the hygienic nature of our SimiWeave products, we cannot accept returns or exchanges for any of them for whatever reason. Consequently refunds are only possible if you cancel your order before it has been dispatched. In such instances we will pass the transaction and administrative charges we would have incurred in processing your order and in processing your refund over to you, resulting in an 15% deduction from your refund. In the unlikely event that the goods are faulty, you have 30 days from the date of delivery to return the goods by signed-for postage in their original packaging and with a note containing your order number and clearly explaining the fault to Imiis Limited, The Amphenol Business Complex, Thanet Way, Whistable, Kent, CT5 3JF, UK, for an assessment. Imiis Limited will notify you of the receipt of your goods once by email and the conclusion of the assessment once by email. (If you do not receive an email from us, you can track the status of the investigation at anytime online by visiting http://www.simiweave.com/customers/index.php. Log on using the email and password you registered with, then select your order ref, then Order Status).  Any correspondence in addition to these two emails will be at our discretion. The assessment can take up to several weeks as it may involve the need to send the goods to manufacturers for inspection. The conclusion will be either that (1) the goods were indeed faulty and alternatives or refunds will be offered and your postage for sending back the goods will refunded; or (2) the goods were not found to be faulty and will be returned to you.

Liability

Our human hair products are chemically processed for colour and texture. Therefore, Imiis Limited does not recommend the use of perms, relaxers, colours, dyes, tints or any other form of chemical processing. Imiis Limited will not assume any responsibility for any damages that might result from the use of perms, relaxers, colours, dyes, tints or any other form of chemical processing. Perms, relaxers, colours, dyes, tints or any other form of chemical processing must not be used on our synthetic hair pieces. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law. Imiis Limited will not be liable in contract, tort, pre-contract or other representations or otherwise out of or in connection with these Terms for any: Economic loss (including without limitation loss of revenue, data, profits, contracts, business or anticipated savings); Loss of goodwill or reputation; Special or indirect losses suffered or incurred by that party arising out of or in connection with the provision of any of the matters under these Terms. The express provisions of these Terms are in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, custom, trade usage, course of dealing or otherwise, all of which are excluded to the fullest extent permitted by law. Notwithstanding the above Imiis Limited's aggregate liability whether in contract, tort or otherwise for loss of damage shall in any event be limited to a sum equal to the amount paid or payable by you for the goods in respect of the incident or series of incidents which are attributable to the same cause. We will not be liable for any delay or failure to meet our obligations under the Terms if such delay or failure is due to any cause beyond our reasonable control. The above does not affect your statutory rights as a consumer or your right to cancel. Imiis Limited reserves the right to assign, transfer, or otherwise delegate (in whole or in part) the benefit of the rights under these Terms to any person.
